Welcome to vatcheck.tax. These Terms and Conditions outline the rules and regulations for the use of the vatcheck.tax website and its Smart API Processing services. PLEASE READ CAREFULLY AS THIS AFFECTS YOUR LEGAL RIGHTS.

By accessing this service, you are entering into a legally binding contract. You unambiguously accept these terms and limitations of liability. Do not use vatcheck.tax if you do not agree to every clause stated on this page.

1. Service Description & "As-Is" Usage

vatcheck.tax is a commercial Software as a Service (SaaS). We provide a proxy layer that transmits VAT identification queries to public government endpoints (UK HMRC and EU Commission VIES). We provide this service strictly on an "AS-IS" and "AS-AVAILABLE" basis without any warranties of any kind.

2. Absolute Limitation of Liability (Critical)

We do not cache, vet, audit, or synthesize VAT verification statuses. We purely relay the exact payload returned by upstream government servers at the exact millisecond of your query.

vatcheck.tax, its developers, and its operators SHALL NOT BE HELD LIABLE OR ACCOUNTABLE under any legal theory (tort, contract, or otherwise) for any direct, indirect, incidental, special, or consequential damages resulting from false negatives, false positives, typographical errors, outdated government databases, or server downtimes originating from HMRC or EU systems. You assume 100% of the financial and legal risk when relying on this data.

3. Maximum Financial Liability

In no event shall our total aggregate liability to you for all damages, losses, or causes of action exceed the total amount paid by you to vatcheck.tax for your current active credit package over the past 30 days. If you are using the free tier, our liability is strictly capped at zero (£0.00).

4. User Indemnification

  • You agree to indemnify, defend, and hold vatcheck.tax harmless against all claims, demands, or fines from tax authorities resulting from your use of this service.
  • You agree not to maliciously scrape or bypass rate limits.
  • You agree you will not use this platform as a substitute for certified professional tax accounting advice.

5. Uptime & API Service Level Agreement

vatcheck.tax depends directly on the uptime of third-party government registers. If the European Commission VIES portal or UK HMRC portal goes down for maintenance, our API will return synchronous upstream errors. We do not compensate, refund, or take responsibility for government-sided downtime.
